Terms and Conditions

Last updated: 24 October 2026

These Terms apply to everyone who uses Beyond The Vacancy (the "Platform"), which is run by Beyond The Vacancy Pty Ltd, ABN 56 701 851 247 ("we", "us").

By creating an account, you agree to these Terms.

1. What the Platform does

Beyond The Vacancy connects dental clinics ("Clinics") with Dental Staff looking for relief work ("Job Seekers"). Clinics post shifts, and Job Seekers apply for them.

We are a marketplace only. We are not the employer, agent or recruiter of any Job Seeker. We don't guarantee that any shift will be filled or that any Job Seeker will be offered work.

2. Accounts

  • You must give true, accurate and current information and keep it up to date.
  • You are responsible for keeping your password safe and for everything done under your account.
  • We may suspend or close accounts that break these Terms or misuse the Platform.

3. Clinics

  • Subscription: using the clinic portal costs AUD $99 per month, including GST, billed automatically each month until you cancel.
  • Shift fees: each shift you publish costs AUD $45 per day of work. You pay this when you publish the shift.
  • Refunds: if a shift's date passes without any applicants, the shift fee is refunded in full automatically. Otherwise, shift fees aren't refundable, except where Australian Consumer Law requires a refund. Free shifts aren't refundable because no fee is paid.
  • Promotions and free access: we may offer free subscription periods or free shift posts, for example a launch offer or a credit we apply to your account. Any free subscription period ends on the date shown when it's offered. After that, your subscription continues at the standard price (AUD $99 per month, including GST) and is charged to the card you gave us, unless you cancel before the free period ends. Free shift posts must be used by their end date, can't be exchanged for cash, and expire if unused. If a free shift receives no applicants, the free post is returned to your account instead of a refund. We may change or end any promotion at any time, but this won't affect benefits already applied to your account.
  • Cancelling: you can cancel your subscription at any time from the Plan page. You keep access until the end of the month you've paid for, and you won't be charged again. We don't refund part-months.
  • Your responsibilities: you are responsible for:
    • checking each Job Seeker's qualifications, registrations and checks before they work
    • agreeing pay and conditions with them
    • paying them
    • meeting all employment, tax, superannuation, insurance and workplace health and safety obligations.

4. Job Seekers

  • The Platform is free for Job Seekers.
  • You must hold, or have applied for, a valid Working With Children Check, plus any other qualifications you state in your profile.
  • You are responsible for turning up to shifts you've been accepted for. If you can't attend, tell the Clinic as soon as possible.
  • Loyalty Program: you may receive an e-gift voucher for every 10 completed shifts. A shift is completed when a Clinic has accepted you and the shift date has passed. We decide the voucher's value, and we may change or end the program at any time.

5. Privacy and contact details

  • A Clinic sees a Job Seeker's contact details, and a Job Seeker sees a Clinic's contact details, only after the Clinic accepts the application.
  • Use another user's details only to arrange the shift. Never use them for marketing or any other purpose.
  • We handle personal information according to our Privacy Policy and the Privacy Act 1988 (Cth).

6. Emails

We send emails needed to run the Platform, such as application updates, acceptances, receipts, reminders and cancellations. Please keep your email address up to date.

Job Seekers may receive new-shift alert emails for shifts posted within their chosen distance. You can change the distance or turn alerts off at any time in your Profile.

7. Acceptable use

You must not:

  • post false, misleading or discriminatory shifts or profiles
  • harass, abuse or mistreat other users
  • try to avoid Platform fees by arranging shifts you found here somewhere else
  • interfere with the Platform's security or how it works.

8. Liability

  • We provide the Platform "as is" and don't guarantee it will always be available or error-free.
  • We aren't responsible for how Clinics or Job Seekers behave, perform or work together, or for any dispute between them.
  • As far as the law allows, our total liability to you is limited to the fees you've paid us in the 3 months before the claim.
  • Nothing in these Terms removes your rights under Australian Consumer Law.

9. Changes

We may update these Terms from time to time. If the changes are significant, we'll let you know by email or on the Platform. If you keep using the Platform after a change, you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Western Australia and Australia.
